COOKIES
Cookies are small text strings that the sites visited by a user send to his/her device, where they are stored and then transmitted back to these sites the next time the same user visits. Cookies may also be sent to the user’s terminal while browsing various web pages (see Data Protection Authority Provision no.229 of 8 May 2014).
In order to ensure their proper regulation, cookies are distinguished according to the purposes of those using them.
TECHNICAL COOKIES
Technical cookies are those used for the sole purpose of “transmitting a communication via an electronic communications network or, to the extent strictly necessary for the provider of an information company service, when explicitly requested by the subscriber or user to provide such service” (see art. 122 (1) of Privacy Code and Provision no. 229/2014).
These may consist of navigation or session cookies, which guarantee normal browsing and use of the website (for example permitting purchases to be made or access to reserved areas to be authenticated).
No prior user consent is required for the installation of such cookies.
PROFILING COOKIES
Profiling cookies are aimed at creating user profiles and are used to send advertising in line with the preferences expressed while browsing online.
Given their invasive nature, users are asked to consent to their installation as provided for by art. 122 of the Code.
ANALYTICAL COOKIES
These are used to monitor the use made of web pages by users by providing statistical reports that can help the publisher to optimise its website. One of the most widely used tools for web analytics is “Google Analytics”, a service of Google Inc. that permits browsing statistics to be collected. The Data Protection Authority has determined that these may be deemed technical cookies if the IP address is anonymised (even partially) and no information is shared with Google. Such cookies will otherwise be deemed to be profiling cookies.
Each cookie may be a first-party cookie (i.e. processed and managed directly by the website owner) or a third-party cookie (if installed and acquired by a different party).
Third-party cookies include so-called social plugins, i.e. components that permit integration into social media (e.g. Facebook, Twitter, LinkedIn, Pinterest, Tumblr, etc.) that operate via the website where they generate cookies.
